Chapter One: Introduction
1.1 Background of the Study
Judicial reviews, particularly through election petition tribunals, play a vital role in ensuring political accountability and the integrity of the electoral process in Nigeria. In Potiskum Local Government, Yobe State, election petition tribunals have served as key institutions for resolving electoral disputes and addressing grievances related to election outcomes. These tribunals provide a legal avenue for challenging election results, thus ensuring that politicians are held accountable for electoral misconduct, fraud, and other irregularities (Ezeani & Obi, 2024). The effectiveness of judicial reviews in ensuring political accountability, however, remains contentious, especially considering the delays, procedural challenges, and sometimes limited scope of these tribunals (Adamu & Bello, 2023). This study examines the role of judicial reviews in maintaining electoral fairness and political accountability, focusing on the effectiveness of election petition tribunals in Potiskum.
1.2 Statement of the Problem
Despite the critical role of judicial reviews in ensuring political accountability, there have been numerous instances where election petition tribunals in Nigeria have been perceived as ineffective or biased, leading to a lack of trust in the electoral process. In Potiskum LGA, Yobe State, electoral disputes have been raised in previous elections, but questions remain about the ability of the tribunals to deliver justice impartially and in a timely manner. The delays in adjudicating petitions, lack of public awareness, and political interference have undermined the potential of judicial reviews to enhance electoral credibility and political accountability (Gana & Sambo, 2023). This study seeks to assess the effectiveness of election petition tribunals in ensuring political accountability in Potiskum, focusing on the challenges and outcomes of judicial reviews in local elections.
